The FBI could be in big trouble. No, I’m not talking about the Fan Belt Inspectors stealing the gold. Read the story everybody involved seems to take the theft by the FBI, as a foregone conclusion. If the FBI lies about stuff like this why should any jury, anywhere, anytime believe an FBI agent when he gets on the witness stand?

This story has been circulating for a while. The new twist is that the search warrant that authorized the FBI search has surfaced. For the uninitiated the court authorizes a search via a search warrant. The court also requires a report, called a “Return” or inventory of how the warrant was executed and what was seized. The lack of the “Return” does not negate the original search or seizure. However, a return that contains false information may constitute perjury. What does the return say? I can’t see a good little bureaucrat with the FBI failing to file a return.

The return could have been sealed. The article mentions “national security.” Any objects recovered were buried 158 years ago. Everybody involved in the original incident are long dead. I guess an uncritical judge could buy off on the notion. The only problem is that with the exception of FISA court judges, most judges tend to get upset when they are lied to.

In thirty years of law enforcement I’ve had numerous suspects, victims and witnesses lie to me. I have also had FBI agents lie to me. Not all crooks have lied to me, some told the truth. Wish I could say the same about FBI agents, but I can’t.
