There are just so many lessons to be learned here. New York City has one of the toughest gun laws in the nation. Get caught with a handgun and upon conviction, it is jail time. There is no probation, or pretrial diversion. That ought to make crook pause. Yeah right!

According to the article, this particular turd is a convicted felon. He was arrested for “jumping a turnstile.” To the uninitiated, he didn’t pay the subway fare, that is $2.75. He was carrying a gun in his waistband and had marijuana packaged for sale in a shopping bag he was carrying. The excuse he gave for not paying? He was late for a court date.

There are some cops involved in this arrest who are going to catch days off. Once they decided to arrest this guy they were justified in conducting a search of his person and items within his possession and control. It is called search incident to arrest verse (Chimel vCalifornia, 395 U.S. 752 (1969 California).

I say justified, but from a street cop perspective it is required. Prisoners are searched to ensure the safety of cops and bystanders. They are searched in order to prevent the destruction of evidence. It doesn’t matter if the officers have any expectation of finding something.

I’m going to make a guess. This guy was arrested on a subway platform. He was then taken to a police station. I suspect that entailed one pair of cops to arrest and another pair to transport. The rule is not only does a cop search a prisoner that he arrests, but he also searches a prisoner that is transferred to him. Assurances that, “he’s been searched,” do not hold any sway. This guy made to the police station.

First lesson, shitheads get up in the morning knowing that they are going to break the law. What they don’t know is where, when or what law. Some carry a gun, legal or illegal it makes no difference.

Jumping a turnstile isn’t an economic thing. It’s a power trip. Crooks do crap like this because they believe that they can. The rules don’t apply to them.

A law abiding person would probably wonder. Why would a convicted felon, unlawfully carrying a pistol and a shopping bag full of marijuana attract attention to himself by evading a subway fare?

Look at it from the crook’s point of view. He has already committed three felonies and it isn’t even lunchtime yet. Why would he pay a subway fare when he almost never does? It just another day at the office.

The contempt for law and order by some segments of society is the reason there is no such thing as a “routine stop” by police. People are like icebergs very little of each are exposed to public view.

New York City has banned “Stop and Frisk.” This situation isn’t a stop and frisk. It is an entirely different animal, a custodial arrest. The article indicates that the crook stated he had a license to carry out of Pennsylvania. That shouldn’t matter. Somebody dropped the ball.
