In any case, in criminal law the threat to use force has to be immediate and of sufficient gravity to overcome the objections of a normal person. So the 2 am phone call to Texas from New York threatening dire deeds if the victim doesn’t put out when next they meet, does not meet the standard for immediacy. I took a report where the guy threatened to strangle the victim’s pet bunny rabbit if she didn’t have sex with him. She did. The District Attorney pointed out she had three roommates all of whom were home and the rabbit was safe in the back yard.

Clark has taken it a step further and included coercion. If you don’t sleep with me, I’ll sleep with your sister, friend, roommate, complete stranger or somebody I made up out of thin air. This is sufficient to trigger a rape accusation at Clark. In order for coercion to be valid as a threat wouldn’t it first have to be established that Clark University girls will put out for damn near any reason? Isolated incidents may not satisfy the reasonable person standard.

When I was in college I was damn glad to have one girl I could drag home at closing time, let alone having alternates in the batters box. It seems to me, to get over the immediacy hurdle there would have to be three of you in bed together and the meter is already running on her competition. I may have it all wrong but it seems that the policy is there for a reason. Clark University apparently is a school where a guy’s announcement that he will go somewhere else is not an empty threat.
