I have always maintained that the most prejudiced person you could ever run across is a liberal and once again I am proved right. This time in Manchester, New Hampshire. Immigrant Crime, Cultural Incompetency: A Congolese immigrant escaped prosecution on six domestic-violence crimes when his lawyer convinced a city prosecutor that he lacked the cultural competency to participate in the American justice system, according to court and public records reviewed by the New Hampshire Union Leader.

Augustin Bahati, age 33, was arrested last August but released on his own recognizance. According to court paperwork, he was accused of striking, pushing, grabbing, kicking and pulling out the hair of a woman who was 27 weeks pregnant at the time. Charges were dismissed because Bahati was deemed to be not competent, not restorable, and not dangerous. The first two may be correct, but his victim would beg to differ on the third.

“The parties agree that the expert reports and analysis indicates that the defendant:

. Not competent

. Not restorable

. Not dangerous

Consequently, the court must dismiss the charges,” Lyons wrote on March 2.

New Hampshire law allows for charges to be dismissed when an expert determines that a mental illness or mental disability has rendered a defendant incompetent to understand the charges against him and assist in his defense.

But an associate attorney general wrote on June 12 that the law contains no provisions for findings of “cultural incompetence.”

“This finding simply does not comport with the legal requirements for a finding of incompetency to stand trial and should have been aggressively litigated,” wrote Associate Attorney General Jane Young.

Where to begin? This case didn’t even make it to trial. It was dismissed by the prosecutor on a motion that has no basis in law. There is no such defense as “Cultural Incompetency.” What the Prosecutor agreed to and the judge signed off on is that a 33-year-old adult male from the Congo is incapable of complying with American law and societal mores and he cannot be taught because he is incapable of learning.

It took me less than a week to housebreak my puppy; now there is a culture gap, but we worked it out.

Correct me if I am wrong, but didn’t we fight a civil war to set aside such thinking? Here it is 150 years later, “poor darkie can’t be on his own, who will look out for him, can’t do it without Massa big brother? If this guy can’t modify his behavior because of cultural incompetence, then there is no way he can qualify for citizenship.

It seems to me that the scale of Negative expectations to No expectations to Low expectations is far more destructive to people than active ill will. At least with the classic KKK stereotype, one can see them coming and prepare. The liberal comes along all smiles, and before long the black man finds himself back out in the fields, this time with a rake and a lawn mower. The more things change, then more they stay the same.
