Is a Bitch Slap an Assault?

I don’t know how things are in California. I’m thinking that if the Oscars had been held in Texas there would be no argument as to whether or not Will Smith assaulted Chris Rock during the presentation. He didn’t. This is my opinion based on the facts and Texas law.

Here is what the Texas Penal code has to say:

Sec. 22.01. ASSAULT. (a) A person commits an offense if the person:(1) intentionally, knowingly, or recklessly causes bodily injury to another, including the person’s spouse; (2) intentionally or knowingly threatens another with imminent bodily injury, including the person’s spouse; or(3) intentionally or knowingly causes physical contact with another when the person knows or should reasonably believe that the other will regard the contact as offensive or provocative.

Bear with me, number one doesn’t apply, there was no claim of bodily injury. Two is out, there was no threat, just a bitch slap. That leaves number three. Nope, I don’t see it. Let’s review, two actors, a stage, an audience, and cameras. No way either of these clowns would recognize offensive or provocative, in that setting, if it bit them in the ass. I’ll refer you to greater authorities than me.

The only injury would have been if the MSM misspelled their names.
