Former Military Lawyers: Chelsea Manning Subject To Prosecution For Running For Office
The he/she known as Bradley Manning has announced his intent to run for the United States Senate, against a Democrat. The problem arises that Manning is not legally qualified to run for office. This isn’t a “how many angels can dance on the head of a pin type argument.” This is bright line law of long standing. There has always been a tension between civil authority and military authority with each side jealously guarding their turf.
The separation of military and civil affairs was considered so important that it was addressed (in another context), in the original “Bill of Rights.”
- Conditions for Quarters of SoldiersNo soldier shall, in time of peace be quartered in any house, without the consent of the owner, nor in time of war, but in a manner to be prescribed by law.
The Posse Comitatus Act of 1878, (18 U.S.C. Section 1385), reads:
"Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both."
This precludes the Army and Air Force from interfering with civilian affairs. It does not apply to the U.S.Coast guard since the Coast Guard falls under the Department of Treasury and is considered a law enforcement agency.
Some of the charges against Bradley were commuted by his co-conspirator, The One. He remains convicted of other charges. Manning is appealing those convictions. Because he is appealing convictions that were had in a military court, Manning is still on active duty but he receives no pay or benefits. As an active duty member of the military Manning can run for Congress, but he cannot campaign or raise money. Hasn’t stopped him.
This seems a roundabout way of doing things, for Manning. Since the rule of law does not apply to Manning and the Democrats here is a more efficient way of going about things. Manning needs to seek out his opponent, Ben Cardin; high noon on the statehouse steps seems good. Once together, all Manning need do is kill Cardin and his entire family. It’s a MAFIA thing, no comebacks. Once the dirty deed is accomplished (dirt cheap) I might add, Manning then declares himself Senator for life. It is important that Manning not sell tickets, video, photo and book rights, as this may smack of campaign fundraising and campaign needs to steer clear of the political action.
