The Great Pumpkin Caper

This shit made sense to the bureaucrats.

New Jersey is unique. Take a drive to New Jersey. It doesn’t cost anything to cross the state line. When it is time to leave, drivers have to stop and pay a toll.

I maintain it is because New Jersey bureaucrats are afraid. They don’t want to chance the possibility that nobody would come to the state, if they had to pay. Leaving is a different story. Visitors discover that no price, is to high in order to leave.

We have this gem, as reported by Legal Insurrection blog. The New Jersey taxing authority has determined that pumpkins may be taxable, based on end use. Pumpkins for pumpkin pie, non-taxable. It is food. Pumpkins for Jack-O-Lanterns, taxable. In that case the pumpkin is not food but a decorative item.

What if the end user intends to make a Jack-O-Lantern, dry the seeds for munchies and use the cutout bits for a pie? Food or decoration? This could lead to a whole new level of bureaucracy.

Which one is taxable?

The first thing to ask is how is the taxing authority going to enforce the tax? Are the stores that sell pumpkins supposed to question the buyer’s intentions? Does this duality of use encompass all foods. Seems like close questioning could result in more sales tax revenues.

Is it food or decoration? Yes!

I guess if I had good sense I’d stop right here. Nope. This whole thing could make grocery shopping fun.

I am glad New Jersey is the way it is. Stupid people need a place to live. Better there than in my neighborhood.
