I once had a Sergeant who was fond of pointing out, “you can be sued by anyone, anytime, for anything.” He was right. I got sued by an ex-con that I arrested on a “blue warrant”. A blue warrant is generated by the board of pardons and paroles and basically means the object of their ire must return to prison to complete his sentence.
Unfortunately, for my parolee, he was in a car with four other people, each of whom had committed additional violations. What should have been one incident with five suspects and arrests on seven charges becomes in the paperwork world seven offense reports, seven arrest reports, seven vehicle impound forms, evidence reports and tracking forms on three offenses, all originals, no copies. What started as a traffic stop at 11:30 pm finished up at 10:30 am.
The county jail does a head count at 2:00 am to determine who gets breakfast beginning at 5:00 am. The breakfast count at 5:00 am establishes who gets lunch. No calling ahead for reservations. My parolee didn’t get breakfast. He didn’t get lunch. I got sued in U.S. District Court for Violating his Civil Rights – Failure to Cater. It didn’t go anywhere but did prove the sergeant’s point.
In Ohio an inmate made Poo-Poo in his pants. He blames the jailer because the jailer wouldn’t let him fall out of line when he requested a bathroom break. The inmate states he suffered embarrassment and humiliation as a result of his accident. He requested 2 million in compensation. The judge dismissed the claim rendering a poetic judgment.
Sounds like a shitty deal all around.
